Acquisitions and Real Estate Finance

The Firm handles real estate transactions for clients, including without limitation the closing of real estate acquisition transactions, mortgage loan refinance transactions and other transactions involving mortgages.

Title Issues

The Firm helps clients create and protect their rights with respect to title to property. This practice area includes, without limitation, the review of title to property to determine the current state thereof, the identification and correction of title discrepancies, the recording of documents with respect to the rights of clients and the issuance of title insurance policies.

Land Use and Planning

The Firm assists real estate developers in land use and planning matters. The Firm advises and assists clients in interpreting and, where necessary or desirable, requesting changes to building codes, zoning regulations and other laws relating to the development of real property. In addition, the Firm assists clients in negotiating and enforcing the terms of agreements involving contractors and subcontractors. In this regard, the Firm’s attorneys are generally recognized as being among the most experienced and the most competent land use attorneys in western Tennessee.

Foreclosures

The Firm assists lien holders in foreclosing on properties securing delinquent loans. In doing so, the Firm protects the lien holder’s interest by handling the foreclosure in a manner which complies with legal and procedural requirements imposed upon foreclosures by applicable law.

Wills and Estates

The Firm advises and assists clients in their estate planning efforts. The Firm utilizes its expertise and skills to assist clients and their estates in minimizing their exposure to tax and other liabilities, ensuring that their assets are distributed in accordance with the wishes of the client, having their health care needs provided for, protecting and managing their assets during their lives and otherwise accomplishing their estate planning goals. In doing so, the Firm often works closely with the financial and tax advisors of the client. These services are provided through the use of various types of wills, trusts, powers of attorney, limited partnerships and other instruments.

Probate

The Firm assists clients in probating wills, and otherwise distributing the assets, of deceased family members and acquaintances. The Firm advises clients regarding the advisability of having the Probate Court oversee their probate, administration or other estate distribution process, as opposed to other means of distribution. For matters involving the Probate Court, the Firm represents clients in Probate Court procedures. In general, the Firm assists clients in making sure their assets are distributed in accordance with their wishes.
